3. User Accounts and Responsibilities

3.1 Account Registration

To post jobs, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account

3.2 Employer Responsibilities

As an employer posting jobs, you agree to:

• Post only legitimate HVAC job opportunities
• Provide accurate job descriptions and requirements
• Not discriminate based on protected characteristics
• Comply with all applicable employment laws
• Not post jobs that require payment from applicants
• Respond to applicants in a professional manner

3.3 Job Seeker Responsibilities

As a job seeker, you agree to:

• Provide truthful information in applications
• Not misrepresent your qualifications or experience
• Respect employer contact preferences
• Not use the Platform for spam or solicitation

4. Payment Terms

4.1 Job Posting Fees

Job postings require a one-time payment. Prices are displayed before purchase and are subject to change. All payments are processed securely through Stripe.

4.2 Refund Policy

We offer refunds under the following conditions:

• Within 24 hours: Full refund if requested within 24 hours of posting and job has not received applications
• Technical issues: Full refund if your job failed to publish due to our technical error
• Duplicate payments: Full refund for duplicate or erroneous charges

Refund requests must be submitted via email to our support team. Refunds are typically processed within 5-10 business days.

4.3 Non-Refundable

Payments are generally non-refundable except as outlined above. Job postings expire after the purchased duration and are not automatically renewed.

5. Prohibited Uses

You may not use the Platform to:

• Post jobs unrelated to the HVAC industry
• Post fraudulent, misleading, or spam content
• Advertise multi-level marketing (MLM) or pyramid schemes
• Request payment from job applicants
• Harvest or collect user data without consent
• Impersonate another person or company
• Upload malicious code or viruses
• Circumvent payment or security measures
• Violate any applicable laws or regulations
• Discriminate based on race, gender, age, religion, disability, or other protected characteristics

6. Content and Intellectual Property

6.1 Your Content

You retain ownership of content you post (job listings, applications, etc.). By posting content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content on the Platform.

6.2 Our Content

All Platform content, design, logos, and functionality are owned by HVAC Jobs Center and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute our content without permission.

7. Limitation of Liability

IMPORTANT: Please read this section carefully.

TO THE FULLEST EXTENT PERMITTED BY LAW:

• The Platform is provided “AS IS” without warranties of any kind
• We do not guarantee job placement or hiring outcomes
• We are not responsible for employer-applicant interactions
• We do not verify employer legitimacy or job authenticity
• We are not liable for any indirect, incidental, or consequential damages
• Our total liability shall not exceed the amount you paid us in the past 12 months

We encourage all users to exercise caution and common sense when using the Platform.

8. Indemnification

You agree to indemnify and hold harmless HVAC Jobs Center, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Platform
• Your violation of these Terms
• Your violation of any third-party rights
• Content you post on the Platform

9. Termination

We reserve the right to suspend or terminate your account at any time for:

• Violation of these Terms
• Fraudulent or illegal activity
• Abuse of the Platform
• Non-payment of fees
• Any reason, at our sole discretion

Upon termination, your right to use the Platform immediately ceases. We are not obligated to provide refunds for terminated accounts due to Terms violations.

10. Dispute Resolution

These Terms, along with our Privacy Policy, constitute the entire agreement between you and HVAC Jobs Center.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
